PURPOSE OF THE POST

The Department invites suitably qualified and experienced legal professionals to apply for the position of Legal Administration Officer (MR5). The successful candidate will provide comprehensive legal advice, litigation support, and administrative law services to the Department, ensuring compliance with applicable legislation, policies, and regulatory frameworks. The post further supports the Department in managing litigation, legislative processes, governance, and information compliance obligations.

REQUIREMENTS

  • A Matric certificate.

  • A Bachelor of Laws (LLB) degree or a four-year legal qualification recognized by SAQA.

  • A minimum of eight (8) years’ appropriate post-qualification legal experience.

  • A postgraduate degree in Law and admission as an Attorney or Advocate of the Bar Council will be an added advantage.

The ideal candidate must demonstrate the following competencies and expertise:

  • Sound legislative knowledge relating to:

    • Litigation frameworks

    • Drafting of contracts

    • Criminal procedure and practice

    • Court rules and procedures

KEY DUTIES AND RESPONSIBILITIES

The successful candidate will be responsible for, but not limited to, the following duties:

  • Provide sound legal advice and litigation support to the Department.

  • Investigate legal matters and compile relevant documentation for submission to the State Attorney.

  • Manage and coordinate litigation on behalf of the Department through the State Attorney, including monitoring court dates, ensuring attendance by departmental officials, and preventing prescription of cases.

  • Conduct legal research on matters to determine liability, prospects of success, and to provide informed legal opinions.

  • Provide legal opinions and support to Human Resources Management, Legal Services, and Labour Relations units on administrative matters, policies, and relevant legislation.

  • Facilitate legislative processes and advise the Department on new legislation and policy developments.

  • Advise the MEC on appeals lodged against administrative decisions taken in terms of applicable legislation.

  • Advise on settlements to minimise unnecessary legal costs.

  • Manage legal consultants and oversee the preparation of court documents to ensure compliance with court rules and deadlines.

  • Appear in court, lead evidence, present legal arguments, and represent the Department during legal proceedings.

  • Draft and deliver persuasive legal arguments by interpreting and applying the law to specific facts.

  • Provide instructions to the State Attorney during court proceedings and assist with briefing Advocates where necessary.

  • Compile evidence from departmental staff and management.

  • Verify and approve invoices submitted by the State Attorney.

  • Analyse legal cases handled by the component and prepare advisory reports on outcomes and risks.

  • Liaise with experts in relevant fields of law when required.

PAIA, PAJA AND POPIA COMPLIANCE

The incumbent will further be responsible for ensuring compliance with information and administrative justice legislation, including:

  • Ensuring compliance with PAIA, PAJA, and POPIA.

  • Conducting data inventories and risk assessments to identify personal information processed, storage locations, and data-sharing practices.

  • Developing and implementing data protection policies, including privacy notices, data retention schedules, and secure destruction procedures.

  • Ensuring lawful processing of personal information in line with the eight conditions for lawful processing.

  • Compiling and publishing a PAIA Manual (often combined with the POPIA Manual).

  • Managing requests for access to information in accordance with prescribed procedures and statutory timeframes.

  • Registering an Information Officer (IO) with the Information Regulator.

  • Establishing and managing internal appeal procedures for information requesters.

  • Ensuring administrative actions are lawful, procedurally fair, and compliant with empowering legislation.

  • Adhering to the Code of Good Administrative Conduct and integrating PAJA requirements into departmental decision-making processes.
